eco Criticizes new German Telemedia Act: Legislator misses opportunity to give clear rejection to the blocking of Internet content

On 2 July 2020, the German parliament, the Bundestag, passed a bill to amend the German Telemedia Act (TMG). eco regrets that the legislator did not take the opportunity to finally eliminate the basis for the blocking of Internet content, which creates legal uncertainty for businesses and citizens alike and is not an adequate means of enforcing copyright claims on the Internet.

eco: European Court of Justice Issues a Rebuff to German Ancillary Copyright

With today's decision, the EUCJ has declared German ancillary copyright law for press publishers to be inapplicable. The Court thus drew a line under the years of debate and numerous court proceedings. From the very outset, eco criticized German ancillary copyright, stating that, “Introducing ancillary copyright in Germany was a misguided political decision.”

The new copyright law remains controversial. The EU Member States Italy, Luxembourg, the Netherlands, Poland, Finland, and Sweden voted against the reform. Belgium, Estonia, and Slovenia abstained. In the end, Germany's approval was the decisive tip on the scales for the necessary majority.

Today, the European Parliament cast its final vote on the European Copyright Directive. With its decision in favor of a European copyright law which includes a European ancillary copyright law and the introduction of upload filters, the European Parliament is flying in the face of a broad alliance comprised of civil society, academics, the digital industry, and Internet politicians – but also journalists, authors, and content creators.
