E-Evidence: On 8 October, the German Federal Cabinet decided that investigative authorities should in the future be able to request and secure electronic evidence – such as chat records, IP addresses or emails – more quickly and directly across national borders.
AI: With its new “Apply AI Strategy”, the EU Commission wants to specifically promote the practical use of artificial intelligence in Europe. The draft includes the development of proprietary frontier AI models, greater use of AI in industry, administration and research, as well as investments of around one billion euros in eleven key industries. The goal is for Europe to move from mere regulation to active application and value creation with AI.
Cybersecurity: The German Federal Office for Information Security (BSI) will take on the role of notifying and market surveillance authority for implementing the Cyber Resilience Act in Germany and will in future be able to independently test IT products for security vulnerabilities. In cases of violations, heavy fines or market bans may be imposed.
CSAM: The discussion surrounding the planned European CSA Regulation continues to face resistance. In Germany, political parties, business associations and civil society organisations are increasingly speaking out against warrantless surveillance of encrypted communications. The current proposal from the Danish Presidency, which includes technical interventions such as “client-side scanning”, is considered by many to be disproportionate and dangerous for privacy protection.
