News CW 47 (20.11.2023-24.11.2023)

AI Act: In a non-paper, the governments of Germany, France and Italy have taken a position on the ongoing negotiations on the AI regulation at EU level. In the paper, the three governments urge mandatory self-regulation for providers of basic AI models, rather than the mandatory requirements envisaged in the AI Act (Euractiv). The European Commission has also published a non-paper in response to the position of the three governments and as a compromise proposal. Among other factors, it proposes a distinction between General Purpose AI (GPAI) models and systems (Euractiv).

e-CODEX: On 23 November, the plenary session of the European Parliament approved the regulation on a computerised system for the cross-border electronic exchange of data in the area of judicial cooperation in civil and criminal matters (e-CODEX). The regulation is intended to allow the use of digital technologies in cross-border judicial proceedings. The result of the inter-institutional negotiations was confirmed with 555 votes in favour, 5 against and 4 abstentions. The regulation will be applicable 15 months after publication in the EU Official Journal. (EP)

Sustainability: In a plenary on Tuesday, the European Parliament adopted its report on the Net Zero Industry Act. In the vote, 376 MEPs voted in favour of the compromise reached in the trilogue; 139 voted against, and there were also 116 abstentions. The aim of the regulation is to increase the EU share in the global market for decarbonisation technologies. As soon as the Council has adopted its negotiating mandate, the trilogue negotiations can begin. (EP)
