Network Enforcement Act (NetzDG): Penalty Guidelines Do Not Eliminate the Danger of Overblocking

Oliver Süme, Chair of the Board at eco, has the following comment to make on the penalty guidelines for the Network Enforcement Act (NetzDG) presented on Friday, 23rd March.

“The penalty guidelines which have now been presented serve to confirm our fundamental reservations against the so-called ‘Network Enforcement Act’. The danger of overblocking as a result of the rigid deletion periods laid down by the act remains and is not resolved by the guidelines. The decisive factor of time inevitably comes at the expense of the care that operators of social networks can take in examining  individual circumstances. In our view, the act thus still stands as a threat to freedom of expression and should be fundamentally revised”.
