Germany after the Elections - Digital Policy Outlook
The European Commission presented its proposal for a European Data Act on 23.02.2022. Alongside the Data Governance Act (DGA), this is one of the EU Commission's central projects in the area of data policy in this term of office and is part of the EU Data Strategy. With its initiative, the Commission is pursuing the goal of supporting data-driven innovations and business models and making the European Union a leading location for data-driven services.
The Data Act focuses on non-personal data generated in the context of IoT applications. The scope of application includes manufacturers of connected products, as well as providers of services based on these products. Dataholders are to be obliged to make their users' data accessible to them and also to pass it on to third parties, such as other companies, at their request. An obligation to share data with the public administration is also envisaged in certain cases. In addition, the Data Act is intended to make it easier to switch between cloud service providers.
